Factors That Influence Parenting Time

A common misconception is that parenting time is influenced by which parent has child custody. That is not correct. Child custody (now referred to in the law as “allocation of parental responsibilities”) refers to which parent is responsible for making decisions regarding the child’s upbringing. This can be awarded to one parent (formerly called sole custody) or both parents (formerly called joint custody).

Whether you have sole or joint custody or the other parent has sole custody, that does not correspond with how much parenting time you will have.

In most situations, the courts award both parents a reasonable amount of parenting time. There must be factors that seriously endanger the child’s physical, emotional or mental well-being for one parent to receive restricted parenting time.
